1. INTRODUCTION

1.1 These Terms and Conditions govern the sale, including registration, of Fmartita products through the website www.fmartita.com.

1.2 The website www.fmartita.com is managed by Marta Ferreira Unipessoal, nif239304144, parish of Fajã de Baixo, municipality of Ponta Delgada, São Miguel Azores.

1.3 For the purposes of these Terms and Conditions,
a) - "Fmartitaconcept» - The products sold on the website www.fmartita.com;
b) - "User" - Any natural person, non-merchant, who places an order through the website www.fmartita.com;

1.4 The use of this website and the purchase of the products presupposes the knowledge, understanding and acceptance of these Terms and Conditions by the User.

2. REGISTRATION ON THE WEBSITE

2.1 To place an order, the User may register in advance, filling in the fields on the form on the website www.fmartita.com. It is also possible to place your order without prior registration.

2.2 From the moment the User accesses his/her personal account, he/she is subject to these Terms and Conditions.

3. OUR PRODUCTS

3.1 The website www.fmartita.com is aimed at all users who wish to purchase fmartita. products from their home or workplace, 24 hours a day, 7 days a week.

3.2 Information on the characteristics of the products can be consulted on our website.

3.3 We reserve the right to modify, at any time, the information, product offer, prices, promotions and commercial conditions, presented on the website www.fmartita.com.

4. ORDERS

The User may place his order online at www.fmartita.com.
In order to successfully complete your order, certain personal data will be required such as your email address, name, address, telephone number, etc. The User must fill in all the mandatory fields for this purpose.
When making an online purchase, the User expresses his/her full and complete acceptance of the general conditions of sale, prices and description of the products included in this transaction. These general conditions of sale will be the only ones applicable between the two parties.

5. PRICES

5.1 The prices of the products displayed on the website www.fmartita.com include Value Added (VAT). The total VAT payable by the User will be indicated on the invoice to be sent to the User.

5.2 Prices are all quoted in euros (€). Please note that changing the country of delivery may affect prices due to different shipping costs. Customs costs related to the country of delivery of the order will be borne by the customer.

5.3 The prices of the products presented on the website are subject to change. Reserve the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.

5.4 If there is an error in the price of the ordered products, Fmartita or the User may, until the order is shipped, cancel the order.

5.5 The total price specified at checkout includes taxes of the country of origin (Portugal) and shipping costs.

5.6 The User must pay only the amount specified in the order confirmation.

6. PAYMENT METHODS

6.1 The User may pay for their purchases through the payment management entity Paypal, through Multibanco Reference (ATM) and MBWay.

6.2 We do not accept any other payment method than those mentioned in the previous point. The User must not attempt to pay by any means other than those specified in the specified payment methods. If you do, we cannot be held liable for loss of payment or any other damages that may arise therefrom.

7. SHIPPING COSTS

7.1 Shipments to Portugal have a cost of €4.90 for standard deliveries. And 6.90 euros for registered deliveries.

7.2 Outside Europe, all orders will have an associated shipping cost, which may require the payment of customs costs, according to the country of delivery.

In case of loss due to incorrect or incomplete address, non-collection at CTT or others outside FMartita, the return costs will be borne by the customer.

8. DELIVERY

8.1 Fmartitaconcept sends the product(s) ordered by the User, from Monday to Friday, from 9 am to 7 pm, with the exception of holidays, and on the days and times used by the logistics company, to the delivery address indicated by the User.

8.2 Our delivery service does not include an scheduling option, so the delivery of the order will be carried out without prior contact by the carrier, being necessary to ensure that someone is at the delivery address.

8.3 Delivery times in Portugal vary between 3– 20 working days depending on the item ordered. The responsiveness of Fmartitaconcept. within these periods varies depending on the availability of stock, as well as during the periods of promotions, sales and Christmas.

8.4 Fmartitaconcept will inform the User of the unavailability of the product(s) ordered, as well as refund the amount paid, within a maximum period of 15 (fifteen) days from the knowledge of the unavailability.

8.5 In case the carrier is unavailable to deliver the products on the indicated date, the User will be contacted in order to indicate another delivery date.

8.6 At the time of delivery, the User must inspect the packaging for possible damage. If you find that the products are damaged, the User must not accept delivery of the order, which will be returned. The User must report the situation, if possible documented with photographs, via the email info@fmartita.com and if you agree, we will resend the order, at no cost to the User. If the User wishes to cancel the order, the full amount paid will be refunded.

9. Applicable Law – The Terms and Conditions of the site are based on Portuguese Law and any dispute situation will be resolved in the Portuguese Courts.

QUALITY

Fmartitaconcept does not sell defective products or products of inferior quality to the standards of those on the market. The main features of each product shown can be found on each product page.
We will make every effort to ensure that the colors of the products that appear on the website www.fmartita.com are as accurate and real as possible. However, as computer monitors vary, we cannot guarantee that your monitor is displaying exact colors.

EXCLUSION AND LIMITATION OF LIABILITY

Fmartitaconcept does not guarantee the uninterrupted operation of the website www.fmartita.com, or any of its features, and it may be suspended for carrying out maintenance, repair or updates.
Likewise, we will not assume any liability for any damages, arising, directly or indirectly, from situations of force majeure that prevent us in any way from fulfilling our obligations, namely strikes, failures in the electrical network, in services of telecommunications or any other services, fires, floods, inability to obtain products, materials or services, breakdowns, delays from suppliers or carriers and changes in legislation or administrative regulations.
Fmartitaconcept is not responsible for any abusive use of the User's access data to the website by third parties, as they are personal and non-transferable.
